The Press-Enterprise, CITY OF JURUPA VALLEY NOTICE OF PUBLIC HEARING NOTICE IS HEREBY GIVEN that the City Council of the City of Jurupa Valley, California, will conduct a public hearing at the City Council Chamber, 8930 Limonite Avenue in said City of Jurupa Valley on Thursday, September 15, 2016 at 7:00 p.m., or as soon thereafter as practical, to consider the following: A PROPOSED MUNICIPAL CODE AMENDMENT AMENDING CHAPTER 11.25 OF THE JURUPA VALLEY MUNICIPAL CODE AND PROPOSED ZONING CODE AMENDMENT (ZCA 1605) AMENDING ARTICLE XVIII OF THE JURUPA VALLEY ZONING ORDINANCE TO PROHIBIT ALL COMMERCIAL MARIJUANA ACTIVITY IN THE CITY, AMEND REGULATIONS REGARDING MARIJUANA CULTIVATION, AND TO PERMIT MARIJUANA DELIVERIES IN THE CITY A staff initiated application to amend Chapter 11.25 of the Municipal Code and Chapter 9.10 of the Zoning Code to prohibit all commercial marijuana activity in the City and to amend regulations pertaining to marijuana cultivation. The City Council will consider the amendment and discuss the implementation of Proposition 64 which will Regulate, Control and Tax the Adult Use of Marijuana Act ("Act") if approved by the voters on the November 2016 ballot, including: 1. MUNICIPAL CODE AMENDMENT. A proposed amendment to Chapter 11.25 of the Jurupa Valley Municipal Code to (1) prohibit commercial marijuana activity (including cultivation, possession, manufacture, distribution, processing, storing, laboratory testing, labeling, and sale of marijuana and marijuana products for commercial purposes) in the City; (2) prohibit marijuana cultivation outdoors, except as allowed for medical purposes under certain conditions, allow the cultivation of up to six marijuana plants indoors for recreational purposes consistent with the Act, and allow the cultivation of up to twelve marijuana plants indoors for medical purposes under certain conditions; and (3) allow marijuana deliveries in the City consistent with the Act. 2. ZONING CODE AMENDMENT NO. 1605. A proposed amendment to Chapter 9.10 of the Municipal Code amending Chapter 17.12 of the County's Zoning to prohibit commercial marijuana activity and marijuana cultivation in all zone classifications except for the cultivation of up to six marijuana plants indoors for recreational purposes. The amendment retains a limited exemption from enforcement to allow the cultivation of up to twelve marijuana plants indoors for medical purposes under certain conditions. 3. Recommend that the ordinance only take effect if Proposition 64, the "Regulate, Control and Tax Adult Use of Marijuana Act" is adopted by the voters in November. Planning Department Staff has determined that the proposed ordinance is exempt from the California Environmental Quality Act ("CEQA"), and the City's CEQA Guidelines pursuant to CEQA Guidelines Section 15061(b)(3) because it can be seen with certainty that there is no possibility that the adoption of this ordinance will have a significant effect on the environment. The ordinance bans commercial marijuana activity in the City and amends regulations pertaining to marijuana cultivation. Placing such a restriction on the use of property will not result in a permanent alteration of property nor the construction of any new or expanded structures. The City Council will consider the proposed ordinance at the public hearing. The City Council staff report for the proposed ordinance may be viewed Monday through Friday, from 8:00 a.m. to 5:00 p.m. (with the exception of holidays) at the City of Jurupa Valley City Hall, Planning Department located at 8930 Limonite Avenue, Jurupa Valley, CA 92509. Any person wishing to comment on the proposed ordinance may do so, in writing, between the date of this notice and the public hearing, or appear and be heard at the time and place noted above. If you challenge this proposed ordinance in court, you may be limited to raising only those issues you or someone else raised at the public hearing described in this notice, or in written correspondence delivered to the City Council at, or prior to, the public hearing. Pursuant to Resolution No. 2016-51, (the "Resolution of Intention") of the City Council of the City of Jurupa Valley, the City Council declared its intention to establish Community Facilities District No. 2016-001 ("Quarry") and to authorize the levy of a special tax (the "Special Tax") therein to finance certain services (the "Services") pursuant to the terms and provisions of the Mello-Roos Community Facilities Act of 1982, as amended, commencing at Section 53311 of the California Government Code (the "Act"). The City Council will consider the amendment and discuss the implementation of Proposition 64 which will Regulate, Control and Tax the Adult Use of Marijuana Act ("Act") if approved by the voters on the November 2016 ballot, including: 1. MUNICIPAL CODE AMENDMENT. A proposed amendment to Chapter 11.25 of the Jurupa Valley Municipal Code to (1) prohibit commercial marijuana activity (including cultivation, possession, manufacture, distribution, processing, storing, laboratory testing, labeling, and sale of marijuana and marijuana products for commercial purposes) in the City; (2) prohibit marijuana cultivation outdoors, except as allowed for medical purposes under certain conditions, allow the cultivation of up to six marijuana plants indoors for recreational purposes consistent with the Act, and allow the cultivation of up to twelve marijuana plants indoors for medical purposes under certain conditions; and (3) allow marijuana deliveries in the City consistent with the Act. 2. ZONING CODE AMENDMENT NO. 1605. A proposed amendment to Chapter 9.10 of the Municipal Code amending Chapter 17.12 of the County's Zoning to prohibit commercial marijuana activity and marijuana cultivation in all zone classifications except for the cultivation of up to six marijuana plants indoors for recreational purposes. The amendment retains a limited exemption from enforcement to allow the cultivation of up to twelve marijuana plants indoors for medical purposes under certain conditions. 3. Recommend that the ordinance only take effect if Proposition 64, the "Regulate, Control and Tax Adult Use of Marijuana Act" is adopted by the voters in November. Planning Department Staff has determined that the proposed ordinance is exempt from the California Environmental Quality Act ("CEQA"), and the City's CEQA Guidelines pursuant to CEQA Guidelines Section 15061(b)(3) because it can be seen with certainty that there is no possibility that the adoption of this ordinance will have a significant effect on the environment. The ordinance bans commercial marijuana activity in the City and amends regulations pertaining to marijuana cultivation. Placing such a restriction on the use of property will not result in a permanent alteration of property nor the construction of any new or expanded structures. The City Council will consider the proposed ordinance at the public hearing.
